TERMS & CONDITIONS
Golden Eagle Process Serving LLC ("we," "us," or "our") provides professional process serving and related legal support services in accordance with applicable North Dakota Rules of Civil Procedure (including N.D.R.Civ.P. 4 and 5), Montana rules where applicable, and other relevant laws.
- Nature of Services We act as independent process servers to effect service of legal documents as requested. Service attempts are made diligently and in compliance with governing rules, but successful service is not guaranteed. Multiple attempts may be required due to factors beyond our control (e.g., evasive individuals, incorrect or incomplete address information, or access restrictions). Additional fees may apply for extra attempts, mileage, or specialized services.
- Client Responsibilities
- You must provide accurate, complete, and up-to-date information about the person or entity to be served, including full name, current or last known address, and any relevant details (e.g., workplace, known routines).
- You represent that the documents submitted for service are valid and that service is being requested for lawful purposes.
- Incomplete or inaccurate information may result in unsuccessful service, additional fees, or cancellation without refund.
- No Legal Advice We are not attorneys and do not provide legal advice, interpretation of documents, or recommendations regarding legal strategy. Our role is limited to serving process as instructed. Consult a licensed attorney for any legal questions.
- Compliance and Proof of Service Upon completion (or exhaustion of reasonable attempts), we will provide an affidavit or proof of service as required by law. This may include details of attempts, dates, times, locations, and any refusals or other observations. We maintain records in accordance with professional standards.
- Limitations of Liability To the fullest extent permitted by law, Golden Eagle Process Serving LLC, its owners, agents, and affiliates disclaim all warranties, express or implied, regarding the services. We are not liable for:
- Failure to serve due to inaccurate information provided by the client.
- Damages arising from the content of the documents being served.
- Any indirect, consequential, incidental, or punitive damages related to our services. Our total liability shall not exceed the fees paid for the specific service request.
- Fees and Payment Fees are based on the type of service, location, number of attempts, and other factors. Payment is required in advance or as agreed. No refunds for unsuccessful attempts due to client-provided inaccuracies.
- Privacy and Confidentiality We handle all information in accordance with our Privacy Policy (available at goldeneaglend.us/privacy-policy) and applicable laws. We do not sell personal information.
- Governing Law Any disputes related to our services shall be governed by the laws of the State of North Dakota.
